Image Rights

All photographs published on hugogrilo.pt are by Hugo Grilo and are protected by the Portuguese Code of Copyright and Related Rights (Decree-Law no. 63/85 of 14 March), which includes photographic works among protected works.

Authorship and rights

The author keeps the moral rights over the photographs, namely the right to be identified as the author and to object to changes that distort the work. The rights of use (reproducing, publishing, distributing or adapting) may only be exercised by third parties with prior written permission.

What is not allowed without permission

  • Copying or downloading the photographs for any use other than viewing them on the website.
  • Publishing them on other websites, social media, press, advertising or printed materials.
  • Altering or cropping them, applying filters, or removing signatures, watermarks or metadata.
  • Selling, transferring or adding them to image banks.
  • Using them to train or feed artificial intelligence systems.

Sharing on social media

You are welcome to share the link to any page of the website. To publish a photograph, please ask for permission first. When permission is given, the post must credit «Photo: Hugo Grilo».

Clients

For commissioned work, each party’s terms of use for the photographs are set out in the proposal and contract for each job. Proposals also state that the images may be used in the photographer’s portfolio.

People in the photographs

The right to one’s image is protected by article 79 of the Portuguese Civil Code, and personal data by the General Data Protection Regulation. If you appear in a photograph on this website and would like it removed, contact me with the page and the image. Every request is reviewed and answered.

Unauthorised use

Using photographs without permission may constitute the crimes of usurpation or counterfeiting (articles 195 to 197 of the Code of Copyright) and gives the right to compensation (article 211). When I find unauthorised use, I ask for the image to be removed or for the corresponding licence fee to be paid and, if necessary, take legal action.

Requesting a licence

To use a photograph, contact me with the following information:

  • the photograph (page address or description);
  • the type of use (website, social media, press, advertising, print);
  • the period and territory of use.

I will reply with the terms and the licence fee.
